Advanced Nano-Coatings, Inc. warrants to the initial purchaser that its Coating Materials will conform to the specifications published by Advanced Nano-Coatings, Inc. which are in effect at the time of the sale. This warranty shall not apply to conditions resulting from misuse, abuse or neglect after shipment by Advanced Nano-Coatings, Inc.

Advanced Nano-Coatings, Inc. liability under this warranty and for all claims relating to product defects, including, without limitation, negligence and strict liability or any other remedy provided by law shall (to the extent permitted by law) in no event exceed the purchase price paid to Advanced Nano-Coatings, Inc. for the particular quantity of the product with respect to which losses or damages are claimed.

Any claim under this warranty must be submitted in writing within 5 years from the date of sale.

Upon receipt of proof of claim satisfactory to Advanced Nano-Coatings, Inc., Advanced Nano-Coatings, Inc. will, at its sole discretion, either replace the non-conforming product or refund the purchase price thereof. This warranty covers materials only and Advanced Nano-Coatings, Inc. shall not be responsible for labor or other costs.

This warranty is in lieu of all other warranties, express or implied, including any warranty of satisfactory quality or fitness for a particular purpose, and Advanced Nano-Coatings, Inc. shall not be liable (in contract, tort or otherwise and irrespective of any negligence or other act, default or omission of Advanced Nano-Coatings, Inc. or its employees or agents) for any loss of profits, use, goodwill, business or anticipated savings, for any indirect or consequential losses or for any third party claims in connection with the products, the provision of technical advice or assistance or this warranty.
